Nationality

On this page, you will find information on the situations in which you may acquire Portuguese Nationality. In each situation you may find information on the requirements, the necessary documents and the payable fee for the submission of the nationality application. We note that there are some subjective requirements, thus it is important to previously analyse if you comply with the necessary conditions under the penalty of not being reimbursed the fee paid for the submission of the application.


General considerations

Portuguese law allows a Portuguese person to have other nationalities. Therefore, in order to apply for Portuguese Nationality you do not need to give up any other nationality. However, you should be aware that the laws of other countries may require that you give up your Portuguese Nationality in order to have (or maintain) the Nationality of one of those countries. Therefore, we advise you to check beforehand if you will be able to keep the nationality of another country, should you acquire Portuguese nationality.

Types of Portuguese Nationality

Applicable situations

– People born in Portuguese territory, children of Portuguese mother or Portuguese father

– Individuals born abroad, children of Portuguese mother or Portuguese father, if one of the parents is abroad at the service of the Portuguese State

– People born abroad, children of Portuguese mother or Portuguese father, who have their birth registered in the Portuguese Civil Registry or if they declare their wish to be Portuguese

– Registration certificate of the parent, which can be dispensed with if the registration is in a national registry office and if the registry office, the year and the registration number are identified

All documents in a foreign language must be translated into Portuguese and legalised by apostille or by Consulate visa of the Portuguese consulate (does not apply to documents issued by authorities of European Union Member States).

Fee

The application for nationality has a cost of 175 Euros.

Applicable situation

– People with a Portuguese nationality ascendant of the 2nd degree in the straight line (grandparents) who has not lost that nationality

Requirements

– Be a descendant of a Portuguese national 2nd grade in the direct line

– Possess effective ties to the Portuguese community

The connection to the Portuguese community is recognised if:

(1) The person has already had legal residence in Portugal for 3 years, is registered with the Finance Department and the National Health System and has attended school in Portugal or proves to have knowledge of the Portuguese language; or

(2) The person has already had legal residence in Portugal for 5 years and is registered with the Finance Department and the National Health System (or regional health services); or

(3) The Government analyses the situation and concludes that this connection exists because the person

  1. has knowledge of the Portuguese language
  2. has legal residence in Portugal
  3. regularly comes to Portugal
  4. has bought or rented a house in Portugal for more than 3 years
  5. lives in or has a connection to an historical Portuguese community abroad
  6. in the last 5 years has participated regularly in the activities of the Portuguese community in the country where he/she lives, for example by attending the activities of the Portuguese cultural and recreational associations of those communities.

– No sentence of imprisonment of 3 years or more, with transit in rem judicatam of the sentence, for a crime punishable under the Portuguese law

– No danger or threat to national security or defence by involvement in activities related to the practice of terrorism

– Birth certificate of the descendant parent of the Portuguese national

– Criminal record certificate from the country of birth and nationality, as well as from the countries where they have resided since the age of 16

– Documents proving the connection to the Portuguese community

All documents in a foreign language must be translated into Portuguese and legalised through an apostille or visa of the Portuguese consulate (not applicable to documents issued by authorities of European Union Member States)

The application for nationality has a cost of 175 Euros.

Requirements

– Married or living together with a Portuguese national for more than three years

– Apply for Nationality for the duration of the marriage

– No prison sentence equal or superior to 3 years, with sentence transited in rem judicatum, for a crime punishable under Portuguese Law

– No danger or threat to national security or defence, due to involvement in activities related to the practice of terrorism

– Not to hold public positions, other than solely technical positions, in another country

– Not to have done non-compulsory military service in another country

– Birth registration certificate;

– Birth certificate of the spouse/roommate, which may be dispensed if the registration is in a national registry office and identifies the registry office, the year and the registration number

– If you are married: you must first register the marriage in the birth registry of the Portuguese national spouse

– If you are de facto united: the certificate of the court judgement where it is recognised that you have been living for more than 3 years in similar conditions to those of married people or a declaration, less than 3 months old, in which the Portuguese citizen confirms that you continue living in a de facto union.

– Documents proving the connection of the person to the Portuguese community (namely, declaration from their employers or from Social Security, the report cards of their children born or registered in Portugal, their IRS declaration, pay slips, water, electricity or rent bills)

– Criminal record certificate from the country of birth and nationality, as well as from the countries where you have had residence from 16 years old

All documents in a foreign language must be translated into Portuguese and legalised through an apostille or visa of the Portuguese consulate (not applicable to documents issued by authorities of European Union Member States).

The application for nationality has a fee of 250 Euros.

Requirements

– Be over 18 years of age

– To have been legally residing in Portugal for at least 5 years

– Sufficient knowledge of the Portuguese language

– Not to have been sentenced to a prison sentence equal to or greater than 3 years, with the sentence having become final and unappealable, for a crime punishable under Portuguese law

– No danger or threat to national security or defence by involvement in activities related to the practice of terrorism

– Birth Registration Certificate

– Criminal record certificate from the country of birth and nationality, as well as from the countries where he/she has resided since the age of 16

– Documentary evidence of Portuguese language (namely a certificate of Portuguese as a foreign language, obtained by taking a test at a recognised Portuguese language assessment centre – minimum level A2). This document is not required if the applicant has been a national of a Portuguese speaking country for more than 10 years.

– Documentary proof of residence in Portugal (Residence Permit issued by the Aliens and Borders Service or European Union Citizenship Certificate)

All documents in a foreign language must be translated into Portuguese and legalised by apostille or visa of the Portuguese consulate (not applicable to documents issued by authorities of European Union Member States).

Fee

The application for nationality has a fee of 250 Euros.

Requirements

– Under 18 years old

– The mother or father must have acquired Portuguese Nationality after the birth of the child

– Have an effective connection to the Portuguese community (have been legally residing in Portugal for 5 years, or be registered with the Finance Department and the National Health System, or prove to be studying in Portugal)

– No prison sentence equal or superior to 3 years, with sentence transited in rem judicatum, for a crime punishable under Portuguese law

– No danger or threat to national security or defence by involvement in activities related to the practice of terrorism

– Birth certificate of the parent who acquired Portuguese nationality

– Document proving the effective connection to the Portuguese community (namely school statement attended in Portugal, or vaccination booklet)

– Criminal record certificate from the country of birth and nationality, as well as from the countries where the applicant has resided since the age of 16

All documents in a foreign language must be translated into Portuguese and legalised through an apostille or visa of the Portuguese consulate (not applicable to documents issued by authorities of European Union Member States).

Fee

The application for nationality has a cost of 200 Euros.

Applicable situations

– People born in Portugal, children of foreigners, if at least one of the parents was also born in Portugal and lived here at the time of the child’s birth,

– Persons born in Portugal, children of foreigners, if at least one of the parents has been resident in Portugal for at least five years at the time of the child’s birth,

– People born in Portugal, children of foreign citizens, if at least one of the parents has been resident in Portugal for at least five years at the moment of the application or the minor has concluded the first cycle of basic education in Portugal.

All documents in a foreign language must be translated into Portuguese and legalised through an apostille or visa issued by the Portuguese consulate (not applicable to documents issued by authorities of European Union Member States).

The application for nationality has a fee of 250 Euros.

Requirements

– be over 18 years of age

– To be a descendant of Sephardic Jews

– Belonging to a Portuguese Sephardic community

– Not to have been sentenced to a prison sentence equal or superior to 3 years, with the sentence having become final and unappealable, for a crime punishable under Portuguese law

– There is no danger or threat to national security or defence, due to involvement in activities related to the practice of terrorism

– Certificate issued by a Jewish community attesting the tradition of belonging to a Sephardic community of Portuguese origin, materialized namely through the applicant’s surname, family language, genealogy and family memory or, alternatively, authenticated documentary records, such as registers of synagogues and Jewish cemeteries, as well as residence titles, property titles, wills and other proofs of the applicant’s family connection, through direct descent or family relationship in collateral line of common progenitor from the Sephardic community of Portuguese origin

– Criminal record certificate from the country of birth and nationality, as well as from the countries where the applicant has resided since the age of 16

All documents in a foreign language must be translated into Portuguese and legalised by apostille or visa of the Portuguese consulate (not applicable to documents issued by authorities of European Union Member States).

Fee

The application for nationality has a fee of 250 Euros.

Requirements

– Being over 18 years of age

– The person must be part of a community that functions as a local Portuguese community located abroad, where most of its members are recognized and proven Portuguese descendents, and where most of its members practice and disseminate values and traditions of Portuguese culture from certain regions of the country.

– No sentence of imprisonment equal or superior to 3 years, with transit in rem judicatam of the sentence, for a crime punishable under Portuguese law

– No danger or threat to national security or defence by involvement in activities related to the practice of terrorism.

Requirements

– Have been born in Portugal

– You must be over 18 years of age

– Have habitually lived in Portugal for more than 10 years

– Sufficient knowledge of the Portuguese language

– Not to have been sentenced to a prison sentence of 3 years or more, with the sentence having become final and unappealable, for a crime punishable under Portuguese law

– No danger or threat to national security or defence, due to involvement in activities related to the practice of terrorism, in accordance with the respective law

– Criminal record certificate from the country of birth and nationality, as well as from the countries where he/she has resided since the age of 16

– Documentary evidence of Portuguese language (namely a certificate of Portuguese as a foreign language, obtained by taking a test at a recognised Portuguese language assessment centre – minimum level A2). This document is not required if the applicant has been a national of a Portuguese speaking country for more than 10 years.

– Document proving the residence in Portugal (Residence Permit issued by Aliens and Borders Service or European Union Citizenship Certificate)

– Documents proving that the applicant has habitually resided in Portugal for more than 10 years (namely having paid Social Security and Taxes contributions, attending an educational establishment, etc.)

All documents in a foreign language must be translated into Portuguese and legalised through an apostille or visa of the Portuguese consulate (not applicable to documents issued by authorities of European Union Member States).
