Fiscal Representative in Portugal: When Is It Mandatory?
🤝 What Is a Fiscal Representative?
A fiscal representative (representante fiscal) is a person or company resident in Portugal who represents a non-resident before the Tax Authority (AT). The representative:
- Receives notifications and letters from the Tax Authority on your behalf
- Can file tax returns and fulfil your tax obligations
- Can exercise your rights — for example, filing complaints or appeals
As a rule, the representative isn’t liable for your taxes — except for VAT, where they can be jointly liable if you’re a VAT-registered self-employed non-resident.
⚖️ What Does the Law Say?
The obligation comes from Article 19 of the General Tax Law (Lei Geral Tributária). Since Decree-Law 44/2022, non-residents can, in most cases, choose between:
- Appointing a fiscal representative, or
- Joining electronic notifications — through the Portal das Finanças mailbox or ViaCTT
🌍 EU and EEA Residents
If you live in an EU country, Norway, Iceland or Liechtenstein, appointing a representative or joining electronic notifications is optional. You just need to keep your foreign address updated.
🌎 Residents Outside the EU/EEA
If you live in a third country (such as the UK, the US, Brazil or Canada) and have a tax relationship with Portugal, you must either:
- Appoint a fiscal representative, or
- Join electronic notifications
What counts as a “tax relationship”?
- Owning property in Portugal
- Owning a vehicle registered in Portugal
- Having an employment contract for work in Portugal
- Working as self-employed in Portugal
If you only have a NIF and none of the above, you don’t need either.
⚠️ When a Representative Is Still Mandatory
Electronic notifications don’t replace the representative if you’re a non-resident self-employed person subject to VAT in Portugal (from outside the EU). In that case:
- You must appoint a fiscal representative before starting the activity.
- The representative must be a VAT taxpayer resident in Portugal.
- They can be jointly liable for your VAT.
Specific rules also apply to non-resident companies with VAT obligations in Portugal.
⏳ Deadlines
- Generally, within 15 days after registering a foreign address or after the tax relationship arises, whichever is later.
- For self-employment: before the start of the activity.
📝 How to Appoint a Representative
- Portal das Finanças: Cidadãos > Serviços > Dados Cadastrais > Representante — the representative must then accept the appointment.
- e-Balcão: online request with supporting documents.
- In person: at a Serviço de Finanças or Loja do Cidadão, usually with a power of attorney.
Who can be a representative? Any person or company resident in Portugal for tax purposes — including foreign citizens with a valid residence permit who are registered as residents.
💸 What If You Don't Comply?
- A fine of €75 to €7,500 (General Regime for Tax Offences – RGIT)
- You may lose the ability to exercise your rights before the Tax Authority, such as complaints and appeals
- You risk missing important notifications — tax assessments, deadlines, enforcement proceedings
💡 Representative or Electronic Notifications?
- Electronic notifications are free — but you must check your mailbox regularly. Notifications are considered delivered even if you don’t open them.
- A representative monitors your tax situation for you, handles deadlines and acts on your behalf — especially useful if you don’t speak Portuguese or have property, rentals or business in Portugal.
🚀 Final Considerations
The fiscal representative is no longer mandatory in every case — but for non-EU residents with property, income or activity in Portugal, you still need either a representative or electronic notifications. Ignoring both can cost you fines and, worse, missed deadlines.
📢 Expert Advice: Electronic notifications are only useful if someone reads them. If you don’t check the Portal das Finanças regularly, a fiscal representative can save you from costly surprises.
